Pongezi Host Agreement

Effective date: 23 October 2026

You accept this agreement when you tick "I have read and accept the Host Agreement and the Pongezi Terms of Service" before paying for a Page.

Between: Mafichoni Limited, operating Pongezi ("we", "us"), and the person creating the celebration page ("you", the "Host").

  1. The service. We create and host a celebration page for your event (the "Page") with a wish wall, M-Pesa contributions, and a dashboard for you, in the package you choose (Essential or Signature).
  1. Package fee. The price is the one shown when you order, including any promotion running at that time. Essential is paid in full before work starts. Signature is paid 50% before design starts and 50% before the Page goes live. Once the Page is live, the package fee is non-refundable. If you cancel before go-live, we refund the fee minus the value of work already done.
  1. Page lifetime. Contributions are open from go-live until 14 days after your event date. The Page stays viewable for 6 months from go-live. You may extend it for KES 1,000 per extra 6 months. You can download all wishes and the contributor list at any time while the Page is live.
  1. Contributions and payouts.
    1. Guests' contributions are paid by M-Pesa to the Mafichoni Limited Paybill. We hold them only on your behalf, as a collection agent, until we pay them out to you.
    2. We pay out daily (above a small minimum), plus a final payout after contributions close.
    3. There is no platform fee. Before each payout we deduct only M-Pesa's own charge for sending the payout to you, at Safaricom's B2C tariff (shown on pongezi.co.ke). Guests pay M-Pesa's usual Paybill charge themselves when they contribute, so nothing is deducted for receiving their gifts. We never deduct more than M-Pesa charges us. Your dashboard shows the gross amount, the charges and the net amount for every payout. If we ever introduce a platform fee, we will tell you at least 30 days before, and it will not apply to a Page created before then.
    4. Payouts go only to an M-Pesa number registered in your name, verified with a KES 10 test. Changing the payout number requires a new verification.
    5. A contribution sent by mistake can be reversed if we're told before it is paid out. After that, the guest must settle it with you directly.
  1. Your responsibilities. You confirm that:
    • the event is real and the Page is for a lawful purpose;
    • you won't impersonate anyone or use the Page to raise money for anything other than the stated celebration;
    • you have the right to publish the photos and text you give us;
    • if the Page is about a child, you are their parent or legal guardian and consent to their photos being shown.
  1. Moderation and suspension. We may hold wishes for review and remove content that is abusive, unlawful or unsafe. We may pause the Page and withhold payouts while we investigate suspected fraud or misuse.
  1. Guests' personal data. You and we jointly decide how guests' names, phone numbers and emails are used: to show wishes, process contributions, and let you thank your guests. You agree to use the contributor list and the contacts guests leave with wishes only for thanking guests about this event, not for marketing, and not to share them. Delete a guest's contact when they ask you to. See the Privacy Notice.
  1. Promotions and showcase. We may offer promotional prices from time to time, on some or all packages and pages. A promotion applies only to orders placed while it is shown. We show your Page as an example of our work only if you agree to it in writing.
  1. Liability. We aren't liable for M-Pesa or network outages beyond our control. Our total liability to you is limited to the package fee you paid plus any contributions we have received and not yet paid out.
  1. Full terms. This agreement sits alongside the Pongezi Terms of Service and Privacy Notice. If they conflict, this Host Agreement prevails. Kenyan law applies. Questions: info@mafichoni.co.ke.
